Introduction

Welcome to Bloom Creative Multimedia Solutions, LLC ("Bloom Creative," "we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before engaging our services.

Services

Bloom Creative Multimedia Solutions, LLC is a creative consulting agency based in Maryland that provides design, branding, and marketing services to small businesses and entrepreneurs throughout the United States.

Client Relationship

  1. Service Agreement: All services require a signed contract specifying deliverables, timeline, and payment terms before work commences.

  2. Communication: The client agrees to provide timely feedback and necessary materials to complete the project as outlined in the service agreement.

  3. Revisions: Each project includes a specified number of revision rounds as detailed in your service agreement. Additional revisions may incur extra charges.

Payment Terms

  1. Fees: Our fees are outlined in the service agreement provided before project commencement.

  2. Deposit: A non-refundable deposit of 50% is required to secure our services and begin work.

  3. Final Payment: The remaining balance is due upon project completion and before the release of final deliverables.

  4. Late Payments: Payments not received by the due date may be subject to a late fee of 15% per month on the outstanding balance.

Intellectual Property

  1. Ownership Transfer: Upon full payment, the client will receive ownership rights to the final deliverables as specified in the service agreement.

  2. Prior to Final Payment: Bloom Creative retains all rights to work created until full payment is received.

  3. Portfolio Rights: Bloom Creative reserves the right to display and link to completed work as part of our portfolio unless explicitly agreed otherwise in writing.

  4. Client Materials: The client guarantees that all elements provided to Bloom Creative for inclusion in the project are legally owned or licensed to the client.

Confidentiality

Bloom Creative agrees to maintain the confidentiality of all proprietary information shared by the client during the course of our engagement.

Project Cancellation

  1. By Client: If the client cancels a project after work has begun, the deposit is non-refundable, and additional payment may be required based on the percentage of work completed.

  2. By Bloom Creative: We reserve the right to terminate services if a client violates these Terms. In such cases, the client remains responsible for payment for all work completed.

Limitation of Liability

  1. Maximum Liability: Bloom Creative's liability is limited to the amount paid for the services in question.

  2. Indirect Damages: We are not liable for any indirect, consequential, or incidental damages arising from our services.

  3. Third-Party Services: We are not responsible for the performance of third-party services or products recommended or utilized in fulfilling our services.

Indemnification

The client agrees to indemnify and hold harmless Bloom Creative from any claims, damages, liabilities, costs, or expenses related to the client's use of our services or deliverables.

Governing Law

These Terms are governed by the laws of the State of Maryland without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms will be resolved through arbitration in the State of Maryland in accordance with the rules of the American Arbitration Association.

Amendments

Bloom Creative reserves the right to amend these Terms at any time. Continued use of our services constitutes acceptance of any modified terms.
